Capacity Building Workshop on the Capacity Building Workshop on the 'Role of Legal Stakeholders in Strengthening and Implementation of the Biological Diversity Act with Special Focus on ABS Provisions' on 16th of May 2015
The Capacity Building Workshop on the Capacity Building Workshop on the ‘Role of Legal Stakeholders in Strengthening and Implementation of the Biological Diversity Act with Special Focus on ABS Provisions’ was held on 16th of May 2015. GCEL in reply to the interest expressed by the Biodiversity Board in organizing a workshop on the Biodiversity Act took up the initiative of collaborating with the Biodiversity Board in organizing the Workshop.
The invitation of call for participants were sent to universities, colleges, advocates, judges, legal academicians, implementing agencies, industries, policy makers, practitioners, members of NGOs, research scholars and other academicians working in field of Agriculture, Medicine, Ecology and Environmental Science. The resources persons were also finalized after the approval of the Biodiversity Board and also arranged for the requirements of venue, food and other requirements including reading material, folders, bags and note pads and books to be provided to the participants and the resources persons.
The Center for Environmental Law of Gujarat National Law University, along with the United Nations Environmental Program, Ministry of Environment and Forests, Gujarat Biodiversity Board, National Biodiversity Authority and Global Environmental Facility organized a capacity-building workshop on ‘Role of Legal Stakeholders in Strengthening and Implementation of the Biological Diversity Act with Special Focus on ABS Provisions’ on 16th May 2015 at the vittan of the University premises. The workshop was marked with the gracious presence of Dr. J.A.Khan, IFS, PCCF & Chairman of Gujarat Biodiversity Board, Mr.B.K.Sinha, Member Secretary, Gujarat Biodiversity Board, Dr.Aeshita Mukherjee-Wilske, State Coordinator, UNEP-GEF-MoEF-ABS Project, along with the participants from different fields. The registration for the workshop began at 9:00 am. The duly arrival of participants and the speakers made it possible to begin the Workshop as scheduled. The workshop began with a warm welcome to the participants by Prof.(Dr.) Mamata Biswal, Dean of Academic Affairs, Gujarat National Law University, followed by a formal inauguration of the workshop and address by Dr. J.A Khan. This was followed with a brief Key note address by Mr. B.K. Sinha. Each of the speakers were welcomed with a memento as a token of appreciation. Thereafter a brief video of the aspects of biodiversity was shown.
In the inauguration address of Dr. J.A.Khan highlighted the importance of Biodiversity and gave a brief introduction of the Gujarat Biodiversity Board and also informed the gathering about the different important species, biodiversity of Gujarat. Thereafter Mr. B.K. Sinha, Member Secretary, Gujarat Biodiversity Board, in which he spoke on the intricacies and the legal challenges that the Biodiversity Board meets day in and day out towards the protection of Biodiversity of Gujarat.
The 1st session was started with screening of documentary on UN Organization dealing with CBD, Nagoya Protocol, the importance of conservation of species and ABS Provisions. Thereafter Prof.(Dr.)Shobhalata V. Udapudi, Director for GNLU Center for Environmental Law spoke on the Legal complexities of implementation of the Biological diversity Act, 2002 along with the Biological Diversity Rules, 2004 and Gujarat Biological Diversity Rules, 2010 with special focus on ABS Provisions. Which was followed by a short tea break which rejuvenated the minds of the participants towards the next phase of the session.
The second speaker for the workshop was Dr. Aeshita Mukherjee-Wilske, State Coordinator, UNEP-GEF-MoEF-ABS Project, informed the participants about the practical aspects of Access and Benefit Sharing mechanism under Biodiversity Act and also the problems that they face in dealing with this in day to day practical life. She also explained the basis of Access and benefit sharing and gave a few examples of how it has helped some countries in developing their biodiversity. She also requested the participants to implement a few measures in their day to day life which would play a role in protecting the biodiversity by making a conscious choice of the food they eat and by valuing the resources that they enjoy in abundance.
The third session started with screening of documentary which showed the Canadian biological park, which talks about conservation, preservation of species and the ABS mechanism. Thereafter the final session was taken up by Mr. Jagadeesh Chandra T G, Assistant Professor of Law, and Gujarat National Law University, who highlighted the Guidelines on Access to Biological Resources and Associated Knowledge and Benefits Sharing Regulations, 2014 in the light of new notification dated 21th November, 2014 issued by Ministry of Environment and Forest and Climate Change, Government of India.
The interactive session turned out to be a healthy round, where the participants fielded the questions to resource persons and they answered with utmost humbleness and tried answering them to the best of their knowledge. The panelists showed enthusiasm in encouraging and answering as many questions as they possibly could.
After the interactive session Dr. Thomas Mathew, Registrar(I/C) delivered the vote of thanks in which he extended his deep gratitude and appreciation to Dr. J.A.Khan , IFS, PCCF & Chairman of Gujarat Biodiversity Board, Mr. B.K.Sinha, Member Secretary, Gujarat Biodiversity Board, Dr. Aeshita Mukherjee-Wilske, State Coordinator, UNEP-GEF-MoEF-ABS Project, Prof (Dr.) Shobhalata Udapudi , for their time and intellectual enlightenment.
At the end Prof. (Dr.) Shobhalata Udapudi, as Director of the Center of Environmental Law, also extended thanks to the management of Gujarat National Law University for their help and cooperation and also extended a sincere thanks to Prof. (Dr.) Bimal N Patel for his constant guidance in the successful completion of the programme. She also thanked the members of GBB for their active participation and the members of GCEL and the student members for their contribution towards the workshop.
Thereafter lunch was served to all the participants and members. The workshop was indeed a success and was praised by many staff members, the members of the Biodiversity Board as well as the participants were highly appreciated the efforts of GNLU for organizing the workshop.
